Arriving at a middle point on an issue like divorce could be very difficult. Before one plunges fully into the sea of the issue, some basic points must be clearly spelt out. One might need to know what causes divorce in the first place. One might also need to which gender opts for divorce the most and why that is so. A study published in the American Law and Economics Review showed that women file slightly more than two-thirds of divorce cases in the US (Brinig & Douglas 126, Khun & John 31). If that is the case, one might want to ask why that is the case. This is just one of the angles to the whole argument.
There is a group of people that believes that every member of the society has the freedom of association and choice, so they should not be hindered from choosing whether to get a divorce or not. Some of them are even of the opinion that the measures in place are already too stringent.
With the trend of things, it is very obvious that there is a need for there to be stiffer measures against divorce because we really need to guard against its high rate. Those that oppose having stiffer measures usually opine that divorce only comes to be when anyone if not pleased in marriage. (That is actually not supposed to be the direct concern of the law). The solution to that might just be that the people need to marry those they truly love (Gallagher 146, Mercer & Marsha 28, McLanahan & Gary 10). We should have harder reforms of the law on divorce because many of the reasons given for divorce are often not cogent.
