4-2 Small Group Presentation: Negligence: McDonald’s Hot Coffee Case

In Module Three, your group researched and discussed the McDonald’s hot coffee case. In Module Four, your group will create a presentation using PowerPoint (or another presentation software of your choice) that identifies the legal claims or defenses that relate to negligence, depending on whether your group is writing in support of the plaintiff or the defendant.

When the project is completed, one member of your group must post your final presentation to the Module Four Small Group Presentation discussion topic.

In response to the other classmates’ presentations, each student must comment individually on at least one other group’s presentation and determine whether the claims or defenses are strong enough, on their own, to successfully state or defeat a claim of negligence against McDonald’s.

If you do not participate in the group presentation and discussion, you will receive a zero for this activity.

Specifically, the following critical elements must be addressed:

Identify all the all key factsprovided in the case study.

Propose additional assumed factsthat could theoretically affect the legal analysis or defense.

Explain all of the key legal elementsof the claims or defenses and suggest alternate legal theories that could be used as a proper legal basis for additional claims or defenses.

Articulate with precision the manner in which the identified facts support or defeatthe stated legal claims or defenses.

Reference a minimum of two comparison casesand use them to support a finding of negligence on the part of the defendant or to defeat the claim of negligence.

Individually respond to at least one other group’s presentation and determine whether the claims or defenses are strong enough, on their own, to successfully state or defeat a claim of negligence against McDonald’s.

What to Submit

The presentation can be submitted in the format selected by the group using PowerPoint (or another presentation software of your choice). The length of the presentation is determined by the group, but the presentation should have a minimum of two slides that comprehensively address each critical element. All sources must be cited in APA format.
